The Clean Air Act 1993 makes it an offence to cause the emission of dark smoke from an open fire on trade or business premises.

Dark smoke will result from burning tyres, roofing felt, foam, plastics, polystyrene, laminate, oil, paints and a host of other material. It is not necessary for an officer to witness the actual burning, evidence of waste having been burned that was likely to have resulted in the emission of dark smoke is sufficient. Fines for dark smoke emission on trade, business or industrial premises, which include sites where such activity is taking place on a temporary basis, for example construction/demolition sites, can be as high as £20,000. It is also an offence to burn cable for the purposes of recovering the metal.
